1. Who we are
OnePic.AI (“OnePic.AI”, “we”, “us”) provides AI-powered image editing tools at onepic.ai (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18 you may only use the Service with a parent or legal guardian's permission. By creating an account you represent that you meet these requirements.
3. The deal — you own and are responsible for what you upload
OnePic.AI is a neutral tool. You decide which photos to upload and what to do with the output. We do not review or pre-approve uploads. By using the Service you represent and warrant:
- You will only upload photos that you own, that you took, or that you have written permission from the rights holder to modify.
- You will not upload photos depicting other identifiable people without their consent (group/yearbook photos in which you appear are permitted — you may modify your own depiction).
- You are solely responsible for the legality of your uploads and the legal use of any output. OnePic.AI does not transfer copyright ownership to you and does not warrant that your use of any output is lawful.
- You will not use the Service to circumvent paywalls or licensing systems for content you do not own.
4. Each upload is a fresh affirmation of these terms
To make the product easy to use we only ask you to check the consent box once per browser. Every subsequent upload nevertheless constitutes a renewed affirmation that you continue to own the image or have legal rights to modify it. We log your IP address, timestamp, and the affirmed consent text on every job. False affirmations are a material breach and may result in account termination and disclosure to the rightful copyright holder in response to a valid legal request.
5. License you grant us
You grant OnePic.AI a limited, non-exclusive, revocable license to store, transmit, and process your uploads solely to deliver the requested AI processing back to you. We do not use your uploads to train models, do not sell them, and do not show them publicly. Source uploads are deleted from storage after 7 days; outputs remain in your dashboard until you delete them.
6. You indemnify us
You agree to defend, indemnify, and hold harmless OnePic.AI, its operator, and its contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) any photo you upload, (b) any output you download, share, distribute, print, or publish, (c) your breach of these Terms, or (d) your violation of any applicable law or any third-party right. This includes any DMCA, copyright, or right-of-publicity claim brought against us as a result of your activity.
7. Pricing
Single photo: USD $1.99 (one-time, 1 credit). Monthly: USD $9.99 for 10 credits per month. Credits roll over up to 30. Subscriptions auto-renew monthly until canceled. You may cancel anytime from the dashboard.
8. Refunds
We offer a 7-day refund on single-photo purchases if AI output quality is unacceptable. Email marshall@onepic.ai with the job ID. Subscription refunds are pro-rated for the unused portion of the current billing period. Refunds are not available for outputs you downloaded.
9. Acceptable use
You may not use OnePic.AI to (a) infringe any third party's copyright, trademark, or right of publicity, (b) harass, defame, or impersonate any person, (c) generate sexual content involving any person who has not consented, including any minor, (d) attempt to evade the consent affirmation, (e) automate abusive volume against our infrastructure, or (f) violate any applicable law. We reserve the right to suspend or terminate any account that we reasonably believe violates these Terms, without notice and without refund.
10. DMCA
We respond to valid DMCA takedown notices within 48 hours. See our Copyright & DMCA Policy. Repeat infringers will have their accounts terminated. We may also suspend an account pending investigation of a single credible claim.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. We do not warrant that the AI will remove every watermark, that output quality will meet your expectations, that the Service will be uninterrupted, or that any information you receive through the Service is accurate. To the fullest extent permitted by law, OnePic.AI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OnePic.AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO OnePic.AI IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. Some jurisdictions do not allow these limits; in that case they apply only to the maximum extent permitted.
13. Arbitration & class action waiver
Any dispute between you and OnePic.AI arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English, in Delaware, USA. You and OnePic.AI agree to waive any right to a jury trial and any right to participate in a class action or representative proceeding. You may opt out of this arbitration agreement by emailing marshall@onepic.ai within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Where arbitration does not apply, disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account for breach of these Terms or for operational reasons with reasonable notice. On termination Sections 5 (license, but only to the extent needed to process pending jobs), 6, 9, 11, 12, 13, 14, and 17 survive.
16. Changes
We may update these Terms from time to time. Material changes will be announced on the homepage or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
17. Entire agreement
These Terms, together with the Privacy Policy and the Copyright & DMCA Policy, are the entire agreement between you and OnePic.AI regarding the Service.
